VILLAGE OF UPPER BROOKVILLE BOARD OF APPEARS PUBLIC NOTICE

A public hearing will be held by and before the Board of Appeals of the Incorporated Village of Upper Brookville, Nassau County, New York, at the Planting Fields Arboretum Hay Barn located on Planting Fields Road, on Tuesday, May 23, 2017 at 6:00 P.M.

The hearing will be on the application of the Chabad of Brookville, owner of a 2­acre par­ cel of land located at 1447 Cedar Swamp Road in the Village designated as Section 18, Block A, Lots 1057A & 1057B on the Land and Tax Map of Nassau County and located within the Village’s R­1 (2 Acre) Zoning District.

The Applicant seeks a conditional use permit to allow the property to be used for religious worship and religious education on a lot having an area of 2.0 acres rather than the required 6 acres;:

The Applicant also seeking approval to construct a place of worship, which structure will require the following variances:

  1. A combined cubic volume of all principal and proximate buildings of 217,100.27 cubic feet rather than the maximum permitted 90,000 cubic feet (Section 205­10­D(1)(a));
    2. An accessory building having a gross floor area in excess of 1,000 square feet (Section 205­
    10­D(3));
    3. To allow the proposed Chabad building to have a front yard setback of 45 feet rather than
    the required 75 feet (Section 205­10­E).

The Applicant further seeks approval to use the existing dwelling for occupancy by the Rabbi and his family, and for temporary religious uses while the new building is being constructed.

At this hearing, the Board of Appeals will consider establishing itself as lead agency pur­ suant to the State Environmental Quality Review Act and referring the application to the Village’s Planning Board for its recommendation pursuant to Section 205­21­A(1) of the Village Code.

The above application and plat are on file at the offices of Humes& Wagner, Attorneys for the Village, 147 Forest Avenue, Locust Valley, NY, where they may be seen during business hours of usual business days until the time of the hearing.

All interested persons will be given an opportunity to be heard. If any individual requires special assistance to attend, please notify the Village Attorney at least 48 hours in advance of the hear­ing.
